Welcome to Pre&Post Pulse, operated by The Fuel Collective, LLC ("Pre&Post Pulse," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of prepostpulse.com and your purchase of our products. By using our site or placing an order, you agree to these Terms.
1. Who we are. Pre&Post Pulse is a monthly subscription box of consumable health, fitness, and nutrition products offered for you to sample and discover. We are a curator and reseller of third-party brand products; we do not manufacture them.
2. Eligibility. You must be at least 18 years old (or the age of majority in your state) to purchase. By ordering, you represent that you meet this requirement and that the information you provide is accurate.
3. Products are for trial and discovery. Our boxes contain sample and full servings of third-party products so you can try them. We make no health, medical, performance, or fitness claims about any product. Always read product labels and consult a physician before using any supplement, especially if you are pregnant, nursing, taking medication, or have a medical condition.
4. Orders and pricing. All prices are in U.S. dollars. We may correct pricing errors, and we reserve the right to refuse or cancel any order, including for suspected fraud or resale. Box contents rotate monthly and are curated at our discretion; specific products are not guaranteed.
5. Subscriptions. Monthly memberships are recurring and governed by our Subscription & Auto-Renewal Terms and Refund & Cancellation Policy, which are incorporated into these Terms.
6. Founder pre-sale. Founder reservations are governed by the Founder Pre-Sale Terms in our Subscription & Auto-Renewal Terms.
7. Accounts. You are responsible for keeping your account credentials secure and for all activity under your account.
8. Intellectual property. The Pre&Post Pulse name, logo, and site content are our property or used with permission. Third-party brand names and marks belong to their respective owners; their appearance does not imply endorsement of us by them.
9. Prohibited use. You may not resell our products or boxes, use the site unlawfully, or attempt to disrupt or misuse the service.
10. Disclaimers. The site and products are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
11. Limitation of liability. To the fullest extent permitted by law, The Fuel Collective, LLC will not be liable for indirect, incidental, or consequential damages, and our total liability for any claim will not exceed the amount you paid us in the three (3) months before the claim.
12. Indemnification. You agree to indemnify and hold harmless The Fuel Collective, LLC from claims arising out of your misuse of the site or violation of these Terms.
13. Changes. We may update these Terms; the "Effective date" reflects the latest version. Continued use after changes means you accept them.
14. Governing law. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Illinois.
